Gotcha Guides is an educational organisation providing learning resources primarily for secondary-school students, teachers, parents, schools and other users in Australia and internationally.
By creating an account, purchasing a product or subscription, accessing paid content or otherwise using Gotcha Guides, you agree to these Terms.
Please read these Terms carefully before purchasing or using Gotcha Guides.

1. About Gotcha Guides
Gotcha Guides provides educational resources relating primarily to English, literature, language, poetry, drama, theatre, film, textual analysis and associated areas of study.
Our resources may include:

2. Educational Purpose
Gotcha Guides is an independent educational resource provider.
Our materials are designed to support students, teachers and others interested in English and related subjects.
Gotcha Guides resources supplement rather than replace:
- Classroom teaching;
- Prescribed texts;
- Official curriculum documents;
- Teacher instructions;
- Assessment notifications;
- Examination requirements; and
- Professional educational advice.
Users remain responsible for determining whether a particular resource is appropriate for their educational needs.
3. Not Curriculum-Specific
Gotcha Guides explores major texts and educational concepts studied across the English-speaking world and internationally.
Unless expressly stated otherwise, our resources are not designed exclusively for one particular curriculum, examination authority, state, territory or country.
Gotcha Guides is not affiliated with, sponsored by or officially endorsed by any curriculum authority, examination board, school system or educational institution unless expressly stated.
Students and teachers should consult their applicable curriculum, syllabus, assessment requirements and educational institution when determining how Gotcha Guides resources relate to their studies.
4. No Guarantee of Academic Results
Gotcha Guides aims to provide useful and high-quality educational resources. However, we cannot guarantee any particular academic outcome.
Using Gotcha Guides does not guarantee:
- Particular marks or grades;
- Improved examination results;
- Successful completion of a course;
- Admission to an educational institution;
- Achievement of a particular educational standard; or
- Any other specific academic outcome.
Academic performance depends on many factors outside the control of Gotcha Guides.
5. Younger Users
Gotcha Guides primarily provides resources relevant to secondary-school education.
Users under the age of 18 are encouraged to obtain permission from a parent or legal guardian before creating an account, purchasing a resource or subscription or providing personal information.
Parents and guardians are encouraged to supervise younger users where appropriate.

6. User Accounts
Certain Gotcha Guides resources require an account.
When creating or using an account, users agree to:

- Maintain accurate account information;
- Keep passwords and login credentials secure;

- Contact Gotcha Guides if they become aware of unauthorised use of their account.

7. Account Sharing
Individual Gotcha Guides accounts must not be shared with unauthorised users.

- Circumvent account or subscription restrictions; or
- Use one individual subscription as a multi-user or school-wide subscription.
Where a school or organisation requires access for multiple users, it should contact Gotcha Guides to discuss an appropriate arrangement.
8. Subscription Types
Gotcha Guides may offer different subscription options and levels of access.
Subscriptions may provide access to combinations of:
- Educational videos;
- PowerPoint presentations;
- PDFs;
- Worksheets; and
- Other educational resources.
The exact inclusions of a subscription will be described on the Gotcha Guides website.
Different subscription types may have different resources and access permissions.
9. Monthly Subscriptions
Monthly subscriptions are billed on a recurring monthly basis.
Unless cancelled, a monthly subscription will automatically renew for the next monthly billing period.
Users may cancel their monthly subscription before the next renewal payment.
Cancellation prevents the next monthly subscription payment from being charged.
Unless otherwise required by applicable law, cancellation does not retrospectively cancel or refund the current paid subscription period.
Users will ordinarily continue to have access to their subscription until the end of the period for which they have already paid.
10. Annual Subscriptions
Annual subscriptions are billed on a recurring yearly basis.
Unless cancelled, an annual subscription will automatically renew for the next annual billing period.
Users may cancel their annual subscription before the next annual renewal payment.
Cancellation prevents the next annual subscription payment from being charged.
Unless otherwise required by applicable law, cancellation does not retrospectively cancel or refund the current paid annual subscription period.
Users will ordinarily continue to have access until the end of the annual period for which they have already paid.
11. Automatic Renewal
Monthly and annual subscriptions automatically renew unless cancelled before the applicable renewal.
By purchasing an automatically renewing subscription, the user authorises the applicable payment provider to process recurring payments according to the subscription selected at checkout.
Users are responsible for cancelling subscriptions they no longer wish to renew.
Nothing in this section limits rights available under applicable consumer law
12. Subscription Price Changes
Where a price change affects an existing subscriber’s future renewal, Gotcha Guides will provide notification of the change where appropriate before the new price applies.
Gotcha Guides may change subscription prices from time to time.
A price change will not retrospectively alter the amount already paid for a completed billing period.
13. Failed Payments
If a recurring payment is unsuccessful, further payment attempts may be made through the applicable payment system.
Access to paid content may be restricted or suspended where payment remains outstanding.
Gotcha Guides may restore access once the outstanding subscription payment has been successfully processed.
14. Individual Purchases
Certain Gotcha Guides resources may be purchased individually rather than through a subscription.
Depending on the particular product, an individual purchase may provide access to:
- Videos available for viewing through the Gotcha Guides website;
- Downloadable PowerPoint presentations;
- Downloadable PDFs;
- Downloadable worksheets; and
- Other materials identified with the product.
The exact inclusions will be displayed as part of the relevant product offering.
Purchasing a resource provides a licence to use that resource in accordance with these Terms. It does not transfer ownership or copyright in the resource to the purchaser.
15. Downloadable Resources
Certain Gotcha Guides resources, including PDFs, worksheets and PowerPoint presentations, may be downloadable.
Authorised users may download and save eligible resources to their devices and print them for their permitted individual educational use.
Downloading a resource does not transfer copyright or intellectual property ownership.
Unless Gotcha Guides expressly provides otherwise, downloaded paid resources remain subject to the restrictions contained in these Terms.
16. Individual Use of Resources
Unless otherwise expressly agreed, Gotcha Guides subscriptions, individual purchases and downloadable paid resources are licensed for individual use only.
Users must not distribute paid Gotcha Guides resources to other individuals, classes, teachers, departments, schools, organisations or the general public without permission.
Resources must not be uploaded to shared Learning Management Systems or similar platforms for access by multiple users unless a separate licence or school arrangement expressly permits this.
17. Printing
Where a Gotcha Guides resource is downloadable, authorised users may print the resource for their permitted individual use.
Permission to print a resource does not grant permission to commercially reproduce, distribute, sell or publicly circulate the material.
18. Modification of Resources
Gotcha Guides resources must not be altered, modified, rebranded or represented as another person’s original resource without permission.
Users must not remove copyright notices, Gotcha Guides branding or other ownership information included in a resource.
19. Video Content
Gotcha Guides video content is provided for viewing through the Gotcha Guides website or through an authorised Gotcha Guides platform.
Unless expressly made available for download by Gotcha Guides, videos are streaming/viewing content only.
Users must not:
- Download videos through unauthorised means;
- Screen-record videos for redistribution;
- Copy or reproduce videos;
- Reupload videos;
- Sell or distribute videos;
- Share paid videos publicly;
- Circumvent video access controls; or
- Make paid video content available to unauthorised users.
20. Distribution Prohibition
Gotcha Guides resources are licensed and protected educational materials.
Unless expressly authorised, users must not:
- Redistribute paid resources;
- Sell or resell resources;
- Upload paid resources publicly;
- Publish resources on another website;
- Share resources through public or unauthorised file-sharing systems;
- Provide copies to unauthorised third parties;
- Package Gotcha Guides resources as part of another commercial product;
- Claim Gotcha Guides resources as their own; or
- Otherwise distribute protected Gotcha Guides content in breach of these Terms.
These restrictions apply regardless of whether a resource has been purchased individually or accessed through a subscription.
21. Artificial Intelligence and Automated Systems
Gotcha Guides resources remain protected by copyright and the distribution restrictions contained in these Terms when used in connection with artificial intelligence or automated systems.
Users must not use Gotcha Guides resources to:
- Create an unauthorised competing educational resource library;
- Systematically reproduce Gotcha Guides content;
- Circumvent our distribution restrictions;
- Train or develop a commercial model or system using substantial Gotcha Guides proprietary materials without permission; or
- Generate and distribute unauthorised reproductions or derivative commercial collections of Gotcha Guides resources.
Nothing in this section transfers any intellectual property rights to a user or third-party AI provider.
22. Intellectual Property
Unless otherwise stated, Gotcha Guides owns or is authorised to use the intellectual property contained in its original educational materials and website.
Protected Gotcha Guides material may include:

- Educational explanations;
- Videos;
- Scripts;

- PowerPoint presentations;
- Activities;
- Study guides;
- Questions;

- Graphics;
- Illustrations;

- Branding;
- Logos; and
- Other original Gotcha Guides materials.
All rights not expressly granted under these Terms are reserved.
23. Third-Party Intellectual Property
Gotcha Guides educational resources discuss, analyse and refer to works created by third parties, including novels, plays, poetry, films and other texts.
All third-party intellectual property, including relevant:
- Titles;
- Literary works;
- Films;
- Quotations;
- Characters;
- Images;
- Trademarks;
- Authorial works; and
- Other protected material
remains the property of the relevant creators, authors, publishers, studios, rights holders or trademark owners, where applicable.
Gotcha Guides does not claim ownership of third-party intellectual property merely because it is discussed or analysed within an educational resource.
Where appropriate, creators, authors or relevant works may be identified verbally, visually, through captions or through other attribution within Gotcha Guides content.
24. Free Content and Social Media
Gotcha Guides may make educational content freely available through its website and various social media platforms.
The fact that content is made freely accessible does not automatically place that content in the public domain or waive applicable intellectual property rights.
Unless expressly stated otherwise, original Gotcha Guides content remains protected even when users can access it without payment.
Users may use ordinary social-media sharing functions to share links or posts where permitted by the relevant platform, but must not reproduce or commercially redistribute protected Gotcha Guides materials without permission.
25. Schools and Educational Organisations
Schools and educational organisations interested in multi-user or institutional access should contact Gotcha Guides.
School subscriptions, licences and other arrangements are negotiated directly with Gotcha Guides.
Separate pricing, access conditions and licensing terms may apply to school arrangements.
An individual subscription does not automatically provide school-wide access.
26. Academic Integrity
Gotcha Guides is intended to help users learn, understand, analyse and develop their academic skills.
Users remain responsible for complying with the academic-integrity requirements of their school, teacher, institution or examination authority.
Gotcha Guides materials should not be submitted as a student’s own original work where doing so would constitute plagiarism, cheating or another breach of academic integrity.
27. Accuracy and Interpretation
Gotcha Guides aims to produce accurate, thoughtful and high-quality educational resources.
However, subjects such as literature, poetry, drama, theatre and film frequently involve interpretation and differing critical perspectives.
Gotcha Guides does not guarantee that every interpretation will correspond with the interpretation preferred by a particular teacher, school, marker, curriculum or examination authority.
Users should refer to their prescribed texts and relevant educational requirements where appropriate.
28. Technical Requirements
Users require an appropriate device and internet connection to access the Gotcha Guides website and view online video content.
Users are responsible for maintaining the internet connection, software, hardware and other technology required to access Gotcha Guides.
Downloaded resources may also require appropriate software capable of opening the relevant file format.
Gotcha Guides is not responsible for problems caused solely by a user’s internet connection, device or incompatible software.
29. Website and Content Availability
Gotcha Guides aims to maintain reliable access to its website and educational resources, but continuous and uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur because of:

Gotcha Guides may update, reorganise, improve, replace or remove content from time to time.
30. Refunds
Subject to rights that cannot lawfully be excluded under applicable consumer law, Gotcha Guides does not provide refunds for change of mind for digital resources or subscription periods that have already been purchased.
This includes circumstances where a user purchases a resource or subscription and later decides that they no longer want or require it.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, refund right or other remedy that cannot legally be excluded.
Where applicable law requires Gotcha Guides to provide a refund, replacement, re-supply or other remedy, we will comply with those obligations.
31. Payments
Payments are processed through Stripe.
Users agree to provide accurate payment information and authorise applicable charges associated with purchases and recurring subscriptions.
Stripe’s processing of payment information is also subject to its applicable terms and privacy practices.
32. International Users
Gotcha Guides provides educational resources to users in Australia and internationally.
Users outside Australia are responsible for ensuring that their use of Gotcha Guides complies with laws applicable to them.
Nothing in these Terms is intended to remove mandatory consumer protections or other legal rights that cannot lawfully be excluded in a user’s jurisdiction.
33. Prohibited Conduct
Users must not:
- Use Gotcha Guides unlawfully;
- Infringe Gotcha Guides intellectual property;
- Redistribute protected paid resources;
- Resell Gotcha Guides materials;
- Share accounts without authorisation;
- Circumvent payment or access restrictions;
- Attempt unauthorised access to another account;
- Interfere with website security;
- Introduce malicious software;
- Systematically scrape or extract Gotcha Guides content;

Nothing in this section limits rights or remedies available under applicable law.

The Privacy Policy should be read alongside these Terms & Conditions.
36. Limitation of Liability
To the maximum extent permitted by applicable law, Gotcha Guides will not be responsible for indirect, incidental, special or consequential losses arising solely from use of, or inability to use, our educational resources or website.
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified.
37. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy available under the Australian Consumer Law or other applicable legislation where it would be unlawful to do so.
Where statutory consumer protections apply, these Terms operate subject to those protections.
38. Changes to These Terms
Gotcha Guides may update these Terms from time to time to reflect changes to our:

- Resources;
- Products;
- Subscriptions;
- Technology;
- Organisation;
- Business practices; or
- Legal obligations.
The current version will be published on the Gotcha Guides website.
Where changes materially affect existing paid subscriptions, Gotcha Guides may provide reasonable notice to affected users where appropriate.
39. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision may be limited or removed to the minimum extent necessary without affecting the remaining Terms, where permitted by law.
40. No Waiver
A failure by Gotcha Guides to immediately enforce a provision of these Terms does not necessarily waive our right to enforce that provision in the future.
41. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia, without requiring Gotcha Guides to publicly disclose the private residential or personal address of any individual associated with the organisation.
This provision operates subject to mandatory consumer protections and other laws that may apply to users in their respective jurisdictions.
